• "Host" refers to any individual or entity that offers a Property for rent through our services.
• "Booking" refers to the reservation of a Property made through our website.
• "Services" refers to all services provided by Miami Rental, including the website, booking platform, and customer support.

3. Account Registration

To access certain features of our Services, you may be required to register for an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.

You are responsible for safeguarding your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. Booking and Cancellation

4.1 Booking Process

When you make a Booking, you agree to pay all charges associated with your reservation, including the rental fee, security deposit, cleaning fee, and any applicable taxes or service fees. All prices are displayed in US dollars unless otherwise stated.

4.2 Booking Confirmation

A Booking is confirmed only after we send you a booking confirmation email. We reserve the right to refuse or cancel any Booking for any reason, including but not limited to, unavailability of the Property, errors in the listing information, or suspected fraudulent activity.

4.3 Cancellation Policy

Cancellation policies vary depending on the Property and are specified on the Property listing page. Please review the cancellation policy carefully before making a Booking. In general, cancellations made at least 30 days before check-in will receive a full refund, less any service fees. Cancellations made within 30 days of check-in may be subject to partial or no refunds, as specified in the Property's cancellation policy.

4.4 Modifications

Modifications to a confirmed Booking may be subject to the Host's approval and may incur additional fees. Please contact us as soon as possible if you need to modify your Booking.

5. Guest Responsibilities

As a Guest, you agree to:

• Use the Property solely for residential purposes and in accordance with these Terms and any house rules provided by the Host.
• Treat the Property, its furnishings, and amenities with care and respect.
• Not exceed the maximum occupancy specified for the Property.
• Not engage in any illegal activities on the Property.
• Not sublet the Property or allow unauthorized guests to stay at the Property.
• Not cause excessive noise or disturbances that may disrupt neighbors.
• Comply with check-in and check-out times as specified in your Booking confirmation.
• Leave the Property in a reasonably clean and undamaged condition.
• Report any damages or issues with the Property promptly.

6. Host Responsibilities

Miami Rental are responsible for:

• Providing accurate and complete information about their Property.
• Ensuring the Property is clean, safe, and ready for occupancy at the time of check-in.
• Promptly addressing any maintenance issues or concerns raised by Guests.
• Complying with all applicable laws, regulations, and tax requirements related to short-term rentals.
• Maintaining appropriate insurance coverage for their Property.
• Providing clear instructions for check-in, check-out, and use of the Property's amenities.

7. Fees and Payments

7.1 Service Fees

We charge service fees for using our platform. These fees help us operate our business and provide customer support. Service fees are non-refundable except as required by law or as specified in these Terms.

7.2 Payment Processing

Payments are processed through our secure payment system. By making a payment, you authorize us to charge the credit card or payment method you provide.

7.3 Security Deposits

Some Properties may require a security deposit. This deposit will be refunded to you within 7 days after check-out, provided there are no damages to the Property. Any damages or extraordinary cleaning costs may be deducted from your security deposit.

8. Limitation of Liability

To the maximum extent permitted by law, Miami Rental, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of or inability to access or use the Services;
• Any conduct or content of any third party on the Services;
• Any content obtained from the Services; and
• Unauthorized access, use, or alteration of your transmissions or content.

Our total liability to you for any damages shall not exceed the amount paid by you to us for the relevant Booking.

9. Indemnification

You agree to defend, indemnify, and hold harmless Miami Rental, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services, your violation of these Terms, or your violation of any third-party rights.

10. Applicable Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Any changes will be effective immediately upon posting the updated Terms on our website. Your continued use of our Services after any such changes constitutes your acceptance of the new Terms.

12. Termination

We may terminate or suspend your access to all or part of our Services, without notice, for any conduct that we, in our sole discretion, believe violates these Terms or is harmful to other users, us, or third parties, or for any other reason.
